"intellectual Deceits"? Senior Legal Officer Act Attorney-general's Department

In most jurisdictions actions which have the natural consequence of bringing about or hastening a person's death, and which are nevertheless knowingly undertaken by another, are likely to be labelled homicide. The basis of this is the principle of the 'sanctity of life' that is that all life is of equal and absolute value. However courts have developed principles which create 'dichotomies'. These dichotomies have been created to preserve the basic principle of sanctity of life while permitting exceptions to it under some morally and socially accepted circumstances. They provide, for example that there is a difference between death through active intervention and death through omission to act the omission cannot be a 'cause' of death. They also provide that an action such as the administration of a drug which in fact causes death is culpable if it is done with the intention of death ensuing, but not if the intention of the act is not to bring about death but rather some other effect such as pain relief.
